A Petition for Release from Lockhart’s ETJ was discussed at Monday night’s Special City Council meeting.

Petition for Release from Lockhart ETJ:

PHAU-Lockhart 450, LLC filed a petition requesting the property’s release from Lockhart’s Extraterritorial Jurisdiction. The petition was filed in accordance with the Texas Local Government Code 42.101-105.

City Council moved that PHAU-Lockhart 450, LLC’s petition to remove property from the City’s ETJ be denied because S.B. 2038 is an unconstitutional delegation of Legislative authority and it conflicts with the Texas Local Government Code section 42.023. The City does not consent to a reduction of its ETJ.

Additionally, Council authorized the City of Lockhart to join the City of Grand Prairie’s lawsuit in challenging the constitutionality of S.B. 2038.
