On May 29, 2024, a charter amendment petition was submitted to the City. This petition proposed amendments to the City's Charter which would reform marijuana enforcement by city personnel, specifically by prohibiting the Lockhart Police Department from making any arrest or issuing any citation for Class A or Class B misdemeanor marijuana possession, except in limited cases.
As a home rule municipality, amendments to the City's charter are governed by state law. When the City receives a proposed charter amendment that is supported by a petition signed by at least five percent (5%) of the qualified voters. The City Council legally is required to order an election for the purpose of voting on the proposed charter amendment. The duty of the members of the City Council to order such an election when the requirements are met is a ministerial one and an election must be ordered. This does not reflect a policy endorsement or support of the measure being presented, but rather only reflects the Council’s duty to follow established state law.
The petition received by the City on May 29 was signed by at least five percent (5%) of the qualified voters of the City of Lockhart. The City Attorney and City Secretary have verified that the signatures on the petition belong to at least five percent (5%) of the qualified voters of the City and consequently ordered the election.
